§1. General provisions and definitions

  3. Pre-contract information:
    • Before submitting the inquiry, the client accepts the Terms and Conditions and Privacy Policy checkboxes (links visible on the website/form). The email offer includes the total price including VAT, shipping costs, and a lead time (2-3 months).
  4. Definitions

    • Client – a natural person, legal person or organizational unit placing an order.
    • Handpan – a musical instrument manufactured to individual order.
    • Order – request for quotation leading to a sales contract.
  5. The Regulations constitute the regulations for electronic services (Act of 18 July 2002 on the provision of services by electronic means)

§1a. Technical requirements and prohibition of illegal content

To use the Store you need: a device with Internet access (PC/phone), a browser (Chrome 50+, Firefox 50+, Safari 10+, Edge 79+), JavaScript enabled, cookies enabled, active e-mail.
The Customer may not upload illegal content (e.g., content that infringes copyright). Violation may result in access being blocked without warning (Article 8, Section 1, of the Act on the Protection of Personal Data).

§2. Scope of business

The shop offers only handpans made to the customer's individual order (selection from the offer or your own specifications: scale, sounds, color, cover, etc.). The products are personalized, not mass-produced.

§3. Order placement and fulfillment process

  • Submission of an enquiry
    The Customer sends a request for quotation via a form with the mandatory acceptance of the Regulations and Privacy Policy checkbox (this information is visible in the e-mail message to the Seller).
  • Quotation and offer
    The vendor sends the customer a price quote and order details.
  • Approval of the order by the customer
    The customer responds to the email, confirming their willingness to process the order.
  • Specifying the account number for the payment
    The seller sends the customer the order details and the account number for payment.
  • Commencement of the contract
    Processing of the order begins once the payment has been credited.
  • The order processing time is from 2 to 3 months and includes both the instrument production process and the delivery time to the customer.

§4 Forms of payment

§5 Delivery

  • Ordered handpans are dispatched via courier service.
  • Delivery is made within Poland and abroad. The cost and details of delivery are agreed individually with the customer.
  • Example shipping costs: Poland 150-250 PLN, EU 250-350 PLN, outside the EU on request. Delivery time: 2-5 days Poland, 5-14 days EU.
  • Packages are fully insured. If there is visible damage to the outer carton upon delivery, we recommend asking the courier to complete a damage report and take photos of the packaging and contents. Please send this information to: handpany@miloscispokoj.pl – this will facilitate quick consideration of the case and filing a claim with the carrier.

§6 Right of withdrawal

  • Due to the individual nature of the orders (custom-made product), there is no right of withdrawal in accordance with Article 38 of the Consumer Rights Act.
  • Before the instrument is sent to the client, the client receives a video showing the sound of the completed handpan. At this stage, the customer has the opportunity to make any comments or suggestions for improvement, allowing the instrument to be fully in line with his or her expectations.
  • The customer is informed about the lack of the right of withdrawal before submitting an inquiry (checkbox in the inquiry form, Art. 12 of the Consumer Rights Act).

§7 Complaints
The customer has the right to make a complaint under the warranty for non-conformity of goods with the contract (Articles 556-576 of the Civil Code) within 2 years of delivery of the goods; in the first year, the defect is presumed (Article 563 of the Civil Code), and the deadline for detecting the defect is 1 year from its discovery. The seller is responsible for defects existing at the time of delivery.

Submit an application by email to kontakt@miloscispokoj.pl: name/surname, order number, description of the defect, photos, request (repair, replacement, price reduction, refund/withdrawal).

In the event of damage occurring during shipping (e.g., visible on the box), please include a damage report prepared with the courier (recommended upon delivery), photos, and a description. Parcels are fully insured – the Seller will process the claim with the carrier after receiving the evidence.
Consideration within 14 days of receipt of the application with proof of posting (e.g. tracking, postal receipt; art. 561^5 of the Civil Code); if accepted, the Seller covers the costs.
The warranty is not limited by the guarantee.

Character of handmade handpans:
Handpans qualify as handmade products. Hand-forming of the note fields and tuning, they give the instrument a unique character. Minor signs of craftsmanship, such as scratches, hammer marks, or minimal surface irregularities on any part of the handpan, are natural to this process and do not constitute grounds for complaint. We guarantee no structural defects affecting sound or functionality.

Complaints do not cover mechanical damage/improper use (rain, sun, dropping).

§8 Guarantee

  • Handpans from the Master Series (Premium stainless steel) are covered by a 24-month warranty against manufacturing defects and a 12-month warranty for one free tune-up at the Seller's service center, provided they are used properly. The customer covers the cost of shipping to the service center. The warranty does not exclude statutory warranty rights (2 years); Exclusions: improper use (rain, sun, dropping).
  • Professional Series (Stainless Steel) handpans are covered only by the statutory warranty (2-year warranty against manufacturing defects in accordance with Art. 556-576 of the Civil Code). Free tuning is not included.
  • Warranty/guarantee claims should be sent by e-mail to: kontakt@miloscispokoj.pl with a description of the problem and photos. As standard our instruments do not require tuning for a long period of time when used properly.

§9. Personal data protection and privacy policy

  1. The Seller is the controller of Customers' personal data. The data is processed solely for the purposes of order fulfillment, customer service, and direct marketing (legal basis: Article 6, paragraph 1, letter b and f of the GDPR).
  2. Detailed information on data processing, purposes, recipients, rights (access, rectification, deletion, objection) and the storage period can be found in Privacy Policy. Order data: 5 years (limitation of claims, Art. 118 of the Civil Code); marketing data: until consent is withdrawn.
  3. Customer rights: complaint to the Personal Data Protection Office https://uodo.gov.pl/. Cookies: consent via a banner on the website (Article 173 of the Telecommunications Law).

§10. Final provisions

  1. The terms and conditions apply from the date of publication on the shop website.
  2. The Seller reserves the right to change the Terms and Conditions. Changes take effect upon publication on the Store's website and do not affect orders placed before the publication date.
  3. Previous versions of the Regulations are available at the Customer's request (by e-mail to kontakt@miloscispokoj.pl) for a period of 2 years (warranty period).
  4. In matters not regulated: Civil Code, Consumer Rights Act, Act on the provision of electronic services.
  5. Competent court: for consumers, according to the place of residence (Article 27 of the Code of Civil Procedure); for entrepreneurs, according to the Seller's registered office.
