§1. General provisions and definitions

- Pre-contract information:
- Before submitting an inquiry, the Customer accepts the checkboxes in the form: Terms and Conditions and Privacy Policy (links visible on the website/form). The Terms and Conditions contain information about the individual nature of custom-made products and the terms of the right to withdraw from the contract. The email offer or message confirming the order details includes the total price to be paid, delivery costs, completion date, and the payment method agreed upon or selected by the Customer.

- Handpan – a musical instrument manufactured to individual order.
- Order – request for quotation leading to a sales contract.
- The Regulations constitute the regulations for electronic services (Act of 18 July 2002 on the provision of services by electronic means)
§1a. Technical requirements and prohibition of illegal content
To use the Store you need: a device with Internet access (PC/phone), a browser (Chrome 50+, Firefox 50+, Safari 10+, Edge 79+), JavaScript enabled, cookies enabled, active e-mail.
The Customer may not upload illegal content (e.g., content that infringes copyright). Violation may result in access being blocked without warning (Article 8, Section 1, of the Act on the Protection of Personal Data).
§2. Scope of business
The store offers musical instruments, particularly handpans, made to individual customer orders. In the case of handpans, orders can include selections from the selection or your own specifications, including scale, number of notes, color, case, and other individual arrangements. Custom-made products are personalized and not mass-produced.
§3. Order placement and fulfillment process

The Customer sends a request for quotation via a form with the mandatory acceptance of the Regulations and Privacy Policy checkbox (this information is visible in the e-mail message to the Seller). - Quotation and offer
The vendor sends the customer a price quote and order details. - Approval of the order by the customer
The customer responds to the email, confirming their willingness to process the order. - Transfer of payment data
The Seller sends the Customer the order details and information about the selected payment method, e.g. bank account number, card payment link or information about installment payment. - Commencement of the contract
The execution of the order begins after the payment is credited to the Seller's bank account or after the Seller receives confirmation of successful payment by card or other selected payment method. - The average waiting time is 2-3 months (with Ekspres service 1 month shorter) and includes both the instrument production process and the delivery time to the customer.
§4 Forms of payment
- Available payment methods may include:
- traditional bank transfer,
- payment by card,
- installment payment for companies, sole proprietorships or private individuals, if this form of payment is available for a given order.
Payment by card may be made via a third-party payment provider or a personalized payment link provided to the Customer by the Seller. Payment card details are handled by the payment provider; the Seller does not store the Customer's full payment card details.

The Seller may provide the Customer with the option to choose installment payment. Installment payment is made through a third-party financing provider or financing institution. Selecting installment payment on the form constitutes a preliminary expression of interest in financing and does not constitute the granting of installments.
The availability of installment payments, their terms, costs, and any repayment schedule are at the discretion of the financing provider. Detailed information regarding financing is provided to the client prior to concluding the financing agreement.
In the case of private customers, the Seller may provide a promotional financing option in which the promotional cost corresponding to financing in 5 installments 0% is covered by the Seller.
If the Customer chooses a longer financing period, e.g. 10, 20, 40 or 50 installments, the promotional part of the financing may be included in accordance with the operator's rules, while the remaining financing costs are borne by the Customer according to the standard offer of the bank or financing operator.
For companies and sole proprietorships, standard corporate installments may be available. Their terms, costs, and financing decisions depend on the financing provider.
If it is not possible to pay by installments, the Customer may choose another available payment method.
Choosing installment payment involves transferring the Customer's data necessary to initiate financing to the appropriate operator (Przelewy24 – individual customers; LeaseLink – companies). Details can be found in Privacy Policy.
§5 Delivery
- Ordered handpans are dispatched via courier service.
- Delivery is made within Poland and abroad. The cost and details of delivery are agreed individually with the customer.
- Example shipping costs: Free in Poland for instrument purchases over PLN 5,000; PLN 150 for orders under PLN 5,000; PLN 250–400 for EU; outside the EU on request. Delivery time: 1–3 days in Poland, 3–7 days in the EU.
- Packages are fully insured. If there is visible damage to the outer carton upon delivery, we recommend asking the courier to complete a damage report and take photos of the packaging and contents. Please send this information to: handpany@miloscispokoj.pl – this will facilitate quick consideration of the case and filing a claim with the carrier.
§6 Right of withdrawal
- Due to the individual nature of orders, custom-made products, particularly handpans, may be non-prefabricated goods, manufactured according to the customer's specifications or designed to meet their individual needs. This applies in particular to the selection of scale, number of notes, tuning, sound arrangement, color, finish, cover, and other individual arrangements with the customer.
- Pursuant to Article 38, point 3 of the Consumer Rights Act, the Customer who is a consumer does not have the right to withdraw from a distance contract without giving a reason if the subject of the service is a non-prefabricated item, manufactured according to the Customer's specifications or intended to meet the Customer's individual needs.
- Before the instrument is shipped to the client, the client receives a video demonstrating the sound of the crafted handpan. At this stage, the client has the opportunity to submit any comments or suggested improvements, which allows for confirmation of the instrument's compliance with the individual specifications.
- The customer is informed about the lack of the right to withdraw from the contract before sending the inquiry, in particular through the content of the Regulations and the Regulations acceptance checkbox in the form.
- The provisions regarding the lack of the right of withdrawal apply only to goods manufactured according to the Customer's specifications or intended to meet his individual needs.
- In the case of ready-made products, not manufactured to the Customer's individual order, the right to withdraw from the contract is granted under the terms of applicable law, unless there is another statutory ground excluding this right.
- The above provisions do not limit the Customer's rights arising from complaints, guarantees or the Seller's liability for non-conformity of the goods with the contract.
§7 Complaints
A customer who is a consumer or an entrepreneur with consumer rights has the right to file a complaint regarding nonconformity of goods with the contract under the terms specified in the Consumer Rights Act. The seller is liable for nonconformity of goods with the contract discovered within two years of delivery, unless otherwise provided by law.
A customer who is an entrepreneur to whom consumer regulations do not apply may file a complaint under the terms of the Civil Code, unless mandatory legal provisions provide otherwise.
Complaints can be submitted via email to: kontakt@miloscispokoj.pl. It is recommended that you include: your name, order number, description of the discrepancy or defect, photos or video recording, and the Customer's request, e.g., repair, replacement, price reduction, or refund, if required by applicable law.
In the event of damage occurring during transport, for example, visible on the box, it is recommended to include a damage report prepared with the courier, photos, and a description. Parcels are fully insured – the Seller will report the matter to the carrier after receiving the evidence.
The Seller will respond to the complaint within 14 days of receiving it.
The Customer's rights regarding complaints are not limited by the warranty.
Character of handmade handpans:
Handpans qualify as handmade products. Hand-forming of the note fields and tuning, they give the instrument a unique character. Minor signs of craftsmanship, such as scratches, hammer marks, or minimal surface irregularities on any part of the handpan, are natural to this process and do not constitute grounds for complaint. We guarantee no structural defects affecting sound or functionality.
Complaints do not cover mechanical damage/improper use (rain, sun, dropping).

§8 Guarantee
- Miłość i Spokój handhelds are covered by a 24-month warranty against manufacturing defects, provided they are used correctly. The customer is responsible for shipping the instrument to the service center. The warranty does not exclude consumer rights arising from non-conformity of the goods with the contract, nor any other rights arising from applicable law.
- Warranty exclusions include misuse, including but not limited to exposure to rain, strong sunlight, storage in highly variable or extreme temperatures, prolonged exposure to moisture, dropping the instrument, severe impacts, and other actions beyond normal, careful use.
- Standard our instruments do not require tuning for a long period of time when used properly.. The warranty does not cover the need to tune or adjust the instrument, which is a natural consequence of time and normal use. If the Customer later determines that the instrument requires tuning or repair (e.g., after a fall, a strong impact, or improper storage), they may use the Seller's paid service. In such a case:
- The Customer sends the Seller a video recording of the instrument being played and a description of the problem noticed.
- Based on the recording and description, the Seller makes an initial assessment and sends the Customer a quote for the service (e.g. tuning of selected sounds, more extensive repair, other service work) and information on the estimated completion time.
- After the customer accepts the quote, the details of shipping the instrument to the service center and the payment method are determined.
- Warranty claims and service inquiries (paid tuning, repairs) should be sent by email to: kontakt@miloscispokoj.pl along with a description of the problem and video material presenting the sound of the instrument.
§9. Personal data protection and privacy policy
- The Seller is the controller of Customers' personal data. The data is processed solely for the purposes of order fulfillment, customer service, and direct marketing (legal basis: Article 6, paragraph 1, letter b and f of the GDPR).
- Detailed information on data processing, purposes, recipients, rights (access, rectification, deletion, objection) and the storage period can be found in Privacy Policy. Order data: 5 years (limitation of claims, Art. 118 of the Civil Code); marketing data: until consent is withdrawn.
- Customer rights: complaint to the Personal Data Protection Office https://uodo.gov.pl/. Cookies: consent via a banner on the website, in accordance with the provisions of the Electronic Communications Law, in particular Article 399 of the EPC.
§10. Final provisions
- The terms and conditions apply from the date of publication on the shop website.
- The Seller reserves the right to change the Terms and Conditions. Changes take effect upon publication on the Store's website and do not affect orders placed before the publication date.
- Previous versions of the Regulations are available at the Customer's request, by e-mail to kontakt@miloscispokoj.pl, for a period of 2 years.
- In matters not regulated: Civil Code, Consumer Rights Act, Act on the provision of electronic services.
- Competent court: for consumers, according to the place of residence (Article 27 of the Code of Civil Procedure); for entrepreneurs, according to the Seller's registered office.
